Twitter started censoring conservatives, so we created our version of Twitter. It is called Parler; well, it WAS, until the left leaning media giants like Apple, Google, and Amazon decided to destroy it. Apple, who makes the iPhone, and Google, who makes the Android blocked users from downloading the app. Similarly, Amazon won’t host the app on its servers. These actions killed free speech and Parler instantly. In a last-ditch effort to save its platform, Parler sued Amazon. The lawsuit is complicated, but without FORUM, it would go nowhere. Forum, or where a case is filed, is worth understanding. Let’s break it down.
Starting simply, this is a civil action, not criminal. That means that no government is involved. There is no prosecution. The penalties for losing would never be jail time. Here the plaintiff, the party suing is Parler. They want a temporary restraining order, which would require Amazon to reinstate the app. They are also seeking damages based on breach of contract, tortious interference, and the Sherman Antitrust Act!
Those are the claims, but it is also essential why the forum is so important. Forum matters because judges are nominated or appointed. When they’re nominated or elected, they run as a conservative or a liberal. A liberal or conservative president also appoints them. SO, if you’re Parler, you don’t want to file in a liberal jurisdiction because the judge (even though they aren’t supposed to) is more likely throw out your case or rule against you based upon his political views. Judges are supposed to be “impartial,” but the problem is that they can find an argument or logic to match whichever point of view they hold.
Having said all of this, the Parler suit’s forum is the United States District Court for the Western District of Washington. The Chief District Judge is Richardo Martinez, who was appointed by George W. Bush in 2003.
