Executive Order Seeks to Protect Second Amendment After Prior Administration

On February 7, President Trump signed an Executive Order designed to protect the Second Amendment Rights of Americans under the U.S. Constitution.

The order sets up a process to review, and potentially revise, initiatives made by the prior presidential administration with respect to Second Amendment rights. 

A summary of the order’s plan of action states: 

“Within 30 days of the date of this order, the Attorney General shall examine all orders, regulations, guidance, plans, international agreements, and other actions of executive departments and agencies (agencies) to assess any ongoing infringements of the Second Amendment rights of our citizens, and present a proposed plan of action to the President, through the Domestic Policy Advisor, to protect the Second Amendment rights of all Americans.”

The plan of action contains a series of review processes regarding government agencies that have a connection to firearms. 

For instance, the Attorney General will review any agencies from 2021 to 2025 – years in which the previous administration was in office – that “purport to promote safety but may have impinged on the Second Amendment rights of law-abiding citizens.”

Moreover, any rules established by the Bureau of Alcohol, Tobacco, and Firearms, and reports from the White House Office of Gun Violence Prevention will be assessed. These are also from the same four-year time frame.

The classification of firearms and ammunition from these agencies will undergo review. The processing of applications to make, manufacture, and transfer firearms will also receive the same treatment. 

Once the plan of action has been submitted, the Attorney General will work with the Domestic Policy Advisor to finalize it and develop a process for its implementation.
