Texas Governor Invokes Invasion Clauses, Sends National Guard, DPS to Border

Texas Governor Greg Abbott invoked the Invasion Clauses of the U.S. and Texas Constitutions on Tuesday, effectively deploying the Texas National Guard, the Texas Department of Public Safety (DPS), and “gun boats” to the border to deter illegal crossings.

Governor Abbot explained that invoking the clause will do the following:

  • Deploying the National Guard to the border and turning back immigrants trying to cross illegally
  • Sending DPS to the border to arrest and return people who crossed the border illegally
  • Build a border wall in multiple counties
  • Deploy gun boats to secure the vorder
  • Designate Mexican drug cartels as foreign terrorist organizations
  • Enter into an agreement with other states to secure the border
  • Enter into agreements with foreign governments to enhance border security
  • Provide resources for border counties to increase their efforts to respond to the border invasion

The Texas Governor also sent a letter to county judges in towns along the southern border, urging them to support him in not only protecting Texans, but also to “ensure that our Troopers and Guardsmen are not exposed to federal criminal prosecution for protecting Texas against illegal entry between the ports of entry.”

Customs and Border Patrol estimate that nearly 5 million people have entered illegally into the United States over the past two years. Meanwhile, DHS has reported that more than 2.7 million illegal immigrants were detained at the border in this fiscal year alone.

Worse, many migrants have died attempting the journey into the country. More than 800 have passed away this fiscal year, and well over 1,000 in the past two. The severity of the situation calls for drastic action, which is what states such as Florida, Texas, and Arizona have taken.

For months, these three states have flown migrants to sanctuary cities around the country, in an effort to not only ease strain on already depleted resources, but also to send a message regarding the disaster that is the southern border. These actions, along with Governor Greg Abbott’s recent involvement of the Invasion Clause, effectively communicated to the nation that the humanitarian crisis is ongoing, and still needs nationwide support.
