
January Littlejohn, a Florida mother whose daughter secretly went through a “social transition” at school, filed a lawsuit in 2022 claiming their school district intentionally deceived parents and concealed information regarding student gender identity.
During the 2020 to 2021 school year, Littlejohn’s daughter was put through a “transgender support plan” and asked what bathrooms she wanted to use, unbeknownst to her mother.
Littlejohn’s suit was dismissed in a federal appeals court in 2022. An appeal in March resulted in the court upholding its decision.
According to EdWeek, the appeals court said the plaintiffs “could not prevail on their parental-rights claim under the 14th Amendment’s due-process clause because school officials’ actions did not ‘shock the conscience.’”
Fox News reports that Littlejohn’s lawsuit is now being supported by American Parents Coalition (APC). The APC filed an amicus brief in the 11th US Circuit Court of Appeals Wednesday on behalf of Littlejohn. Alliance Defending Freedom is also in support of Littlejohn’s suit.
Littlejohn was in attendance for President Donald Trump’s Joint Address to Congress. The President spoke about her story during his speech:
“A few years ago, January Littlejohn and her husband discovered that their daughter’s school had secretly socially transitioned their 13-year-old little girl,” Trump said during his address. “Teachers and administrators conspired to deceive January and her husband, while encouraging her daughter to use a new name and pronouns—‘they/them’ pronouns, actually—all without telling January, who is here tonight and is now a courageous advocate against this form of child abuse.”
APC is arguing that “gender transitioning” is a form of medical treatment that parents have the due process right to know about and be able to refuse for their children.
