California Judge Overturns Three Decade Assault Weapon Ban
A California judge actually stood up for gun laws?!
In San Diego, California, a federal judge overturned the three-decade ban on assault weapons, referencing that it violates the Second Amendment.
“Under no level of heightened scrutiny can the law survive,” said U.S. District Judge Roger Benitez.
District Judge Benitez argued that Californian gun owners were deprived of their rights because of the state’s definition of illegal military-style rifles allowed in other states.
The judge also issued a permanent injunction that will go into effect 30 days from June 4, 2021.
He was scrutinized because he compared the AR-15 rifle to a Swiss Army knife, saying it’s “a perfect combination of home defense weapon and homeland defense equipment. Good for both home and battle.”
In my opinion, I believe that was taken out of context by the anti-gun advocates because he’s not saying they are the same thing but that both of those options are a good combo for both home and battle defense.
There are currently an estimated 185,569 assault weapons registered with the state of California despite the ban.
Of course, we have to hear from Governor Gavin Newsom from a tweet:
Many groups, including San Diego County Gun Owners Political Action Committee, California Gun Rights Foundation, Second Amendment Foundation, and Firearms Policy Coalition, are the ones who filed this lawsuit and are advocating against the state with the strictest gun laws.
California’s Attorney General Rob Bonta stated that the state will be appealing the ruling.
The state is also appealing other gun-related rulings, including District Judge Benitez’s 2017 ruling against the state’s ban on the sales and purchases of magazines holding more than 10 bullets and his 2020 decision that blocked a California law in 2019 requiring background checks for anyone buying ammunition.
